1. Introduction

These Terms and Conditions govern the enrolment and participation of students in courses offered by The Institute of EI (ABN: [INSERT ABN], RTO Code: [INSERT RTO CODE]) (“the Institute”). By enrolling in a course, students agree to be bound by these Terms and Conditions.

2. Enrolment

  • Enrolment is confirmed upon receipt of a completed application and payment of applicable fees.
  • The Institute reserves the right to decline an application or cancel an enrolment where entry requirements are not met, or where enrolment would not be in the best interests of the student.
  • Students must ensure all information provided at enrolment is accurate and complete. Providing false information may result in cancellation of enrolment.
  • Students enrolling in accredited courses must hold or obtain a Unique Student Identifier (USI) prior to commencement. Qualifications cannot be issued without a verified USI.

3. Student Obligations

Students are expected to:

  • Attend and actively participate in all scheduled training and assessment activities
  • Submit assessment tasks by the specified due dates
  • Conduct themselves professionally and respectfully toward staff, other students, and third parties
  • Notify the Institute promptly of any change in contact details or circumstances affecting their ability to complete the course
  • Comply with the Institute’s Online Learning Standards when engaging with the online learning environment
  • Not engage in plagiarism, academic fraud, or any form of cheating
  • Respect the intellectual property rights of the Institute and other parties

4. Code of Conduct

The Institute expects all students to behave in a manner that is:

  • Respectful of the rights and dignity of others
  • Free from harassment, bullying, discrimination, or intimidation
  • Consistent with the values of the Institute: integrity, curiosity, and care

Breaches of the Code of Conduct may result in a formal warning, suspension, or cancellation of enrolment at the discretion of the Institute.

5. Assessment

  • Assessment tasks and deadlines will be communicated at the commencement of each course.
  • Students may request an extension by contacting their trainer prior to the due date. Extensions are granted at the discretion of the Institute.
  • Where a student does not achieve a satisfactory result on their first assessment attempt, one resubmission opportunity will be provided at no additional charge. Subsequent resubmissions may incur a fee as per the Fee Schedule.
  • Assessment decisions may be appealed in accordance with the Complaints & Appeals Policy.

6. Intellectual Property

All course materials and content provided by the Institute are the intellectual property of the Institute or its licensors. Students may not reproduce, distribute, or commercially exploit these materials without prior written consent.

Assessment work submitted by students remains the intellectual property of the student, however the Institute may retain copies for compliance and quality assurance purposes.

7. Fees and Refunds

Fees are payable in accordance with the Fee Schedule. Refund entitlements are set out in the Refund Policy. Both documents are available at [INSERT URL].

8. Privacy

The Institute collects and handles student personal information in accordance with its Privacy Policy, available at [INSERT URL].

9. Certification

Upon successful completion of an accredited course, students will be issued the relevant qualification or statement of attainment within 30 days of the final assessment outcome being confirmed. For non-accredited courses, a certificate of completion will be issued upon meeting all requirements.

  • Certificates will be issued electronically unless otherwise requested.
  • Replacement certificates may be requested for a fee as per the Fee Schedule.

10. Limitation of Liability

To the extent permitted by law, the Institute’s liability to any student is limited to the re-supply of the relevant training service or a refund of the fees paid for that service.

The Institute is not liable for any indirect, consequential, or special loss or damage arising from enrolment in or delivery of a course.

11. Changes to These Terms

The Institute may update these Terms and Conditions from time to time. Students will be notified of material changes by email. Continued participation in a course following notification of changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms and Conditions are governed by the laws of [INSERT STATE/TERRITORY], Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of that state or territory.
